中国就《数据安全管理办法(征求意见稿)》征求公众意见

China's Internet regulator started to solicit public opinions on data security regulation on Tuesday.

周二(5月28日)，国家网信办开始就《数据安全管理办法(征求意见稿)》，向社会公开征求意见。

According to a draft regulation released by the Cyberspace Administration of China, network operators must not force or mislead users to agree to the collection of their personal information on the pretext of improving service quality, enhancing user experience, sending customized push messages or developing new products.

根据征求意见稿，网络运营商不得以提高服务质量、增强用户体验、发送定制推送信息或开发新产品为由，强迫或误导用户同意收集其个人信息。

The regulation applies to network-based collection, storage, transmission, processing and use of data, as well as data security protection and supervision in China, said the draft.

意见稿明确，这项规定适用于在中国境内利用网络开展的数据收集、存储、传输、处理、使用等数据活动，以及数据安全的保护和监督管理。

The draft requires network operators to make and release the rules of data collection and usage via websites or applications. The operators must not provide discriminatory services to users based on whether they accept personal information collection and the collection scope.

意见稿要求网络运营者通过网站、应用程序等产品收集使用个人信息，应当分别制定并公开收集使用规则。经营者不得根据是否接受个人信息收集和收集范围，向用户提供歧视性服务。

The draft also requires operators to take remedial measures immediately when personal information leakage, damage, or loss happens, or when data security risks increase significantly.

意见稿还要求运营商在个人信息泄露、损坏或丢失或数据安全风险显著增加时，应当立即采取补救措施。

The draft will be open for suggestions until June 28.

意见反馈截止时间为2019年6月28日。
